1. Acceptance of terms

By accessing or using GetMarkd ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. What GetMarkd is

GetMarkd is a free, editorial directory of tattoo parlors operating across the United States. We aggregate publicly available information — names, addresses, hours, photos, reviews — and present it in a curated format. We do not own, operate, endorse, or take payment from the studios listed unless explicitly stated.

3. Accuracy of listings

We do our best to keep listings accurate, but we cannot guarantee that hours, prices, artists, styles, or contact details are correct at any given moment. Always confirm directly with the studio before visiting. GetMarkd is not responsible for any consequence of relying on listed information.

4. Accounts

You may create an account to save parlors. You are responsible for the accuracy of your account information and for all activity under your account. You must be at least 13 years old to create an account.

5. Acceptable use

You agree not to:

• Scrape, copy, or republish substantial portions of the directory without written permission.
• Submit false, misleading, or defamatory information.
• Use the Service to harass studios, artists, or other users.
• Attempt to disrupt, attack, or reverse engineer the Service.

6. Intellectual property

The GetMarkd name, logo, layout, original written guides, and editorial selections are owned by GetMarkd. Studio names, photos, and review text remain the property of their respective owners and are displayed under fair use, license, or with permission.

7. Third-party links and ads

The Service contains links to third-party websites (studio sites, social profiles, map providers) and may display third-party advertising. We are not responsible for the content, accuracy, or practices of those third parties.

8. Disclaimer

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

9. Limitation of liability

To the maximum extent permitted by law, GetMarkd will not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service.

10. Markd Roulette (the spin wheel)

Markd Roulette, available at /spin, is a novelty randomizer provided strictly for entertainment and amusement purposes. The styles, body placements, sizes, and motifs it generates are produced by a pseudo-random algorithm and do not constitute a recommendation, medical advice, professional advice, design consultation, or any form of endorsement.

By using Markd Roulette, you acknowledge and agree that:

• You are solely responsible for any decision to obtain a tattoo and for selecting a qualified, licensed tattoo artist. Tattoos are permanent, carry health and safety risks, and should never be undertaken impulsively or while impaired.
• GetMarkd does not perform tattoos, does not employ or supervise any tattoo artist, and does not control, guarantee, or verify the quality, safety, hygiene, licensing, pricing, availability, or conduct of any studio or artist listed or linked to from the Service.
• You must be of legal age to receive a tattoo in your jurisdiction (18+ in Texas, with no parental-consent exception under Texas Health & Safety Code § 146).
• The Service is not a substitute for in-person consultation with a licensed tattoo professional or, where applicable, a licensed medical provider.

To the maximum extent permitted by law, GetMarkd, its owners, operators, employees, and affiliates disclaim all liability for any direct, indirect, incidental, special, consequential, punitive, emotional, physical, financial, reputational, relational, or aesthetic damages — including but not limited to tattoo regret, poor artistic outcomes, infections, allergic reactions, removal costs, lost wages, employment consequences, relationship disputes, or social-media embarrassment — arising out of or relating to your use of, or reliance on, Markd Roulette or any result it generates. By spinning the wheel, you accept all risk and release GetMarkd from any and all claims related to actions you take in response to its output.

11. Changes

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict of law rules.
